SC finds no legal bar for Shahabuddin to take oath as president

The Supreme Court chamber judge on Tuesday affirmed a High Court decision that rejected a writ suit contesting the legitimacy of the procedure used to elect Md Shahabuddin as president of the nation.

A writ petition filed by MA Aziz Khan contesting the HC ruling was denied by the chamber judge of the Appellate Division Justice Jahangir Hossain Selim. In the petition, he requested stay on the HC decision as well as the gazette notification that announced Md. Shahabuddin as the new president.

According to Assistant Attorney General SK Md Morshed, during a news conference held in the attorney general’s office, there is no legal obstacle preventing Md Shahabuddin from taking the oath of office and performing other pertinent duties following the ruling of the highest court chamber judge.

The SC chamber judge rejected MA Aziz Khan’s appeal, he continued, on the grounds that Md Shahabuddin’s election as president of the Republic did not violate the law or the constitution because the job of president is not one that provides for financial gain in the government.

When MA Aziz Khan spoke for himself at the hearing, a number of attorneys, including ABM Altaf Hossain, spoke on behalf of Md. Shahabuddin.

On March 15, the HC Summerly dismissed two distinct writ petitions that questioned the validity of the procedure used to choose Md Shahabuddin as the nation’s president.
