The Appellate Division of the Supreme Court denied three requests for leave to appeal against the decision of the High Court that the tax imposed on Prof. Dr. Muhammad Yunus’ contributions to three trusts was appropriate.
The applications were denied by the four-member bench, presided over by Chief Justice Hasan Foez Siddique.
For the assessment years 2011–2012 to 2013–2014, the Deputy Commissioner of Taxes (DCT) of Taxes Zone–6 in Dhaka levied a “gift tax” on the given funds.
The Tax Appellate Tribunal confirmed the DCT’s ruling despite Prof. Yunus’ appeal petitions against the tax imposition. Objecting to the tax duty on the donated money, Prof. Yunus filed three reference cases, which were dismissed by the High Court bench.
The HC court further determined that the DCT did not violate any laws by enforcing the tax.
